LISTS 1, 2, AND 3 DUTY INCREASE: On September 3, 2019, the US Trade Representative issued a request for comments on the proposed increase of additional duty rates on $250 billion in Chinese goods (Lists 1, 2, and 3) from 25% to 30%, effective October 1, 2019.

Written comments concerning the proposed modification are due September 20, 2019.

LIST 4B DUTY INCREASE: On August 30, 2019, the USTR published modifications to the duty rates on the $300 billion Section 301 tariff action (FR 45821). The Federal Register notice can be viewed here.

The rate of additional duty for products covered by Annex C of the August 20 notice (LIST 4B) will be 15% effective December 15, 2019.

LIST 3 EXCLUSION REQUESTS NOW ACCEPTED: The USTR continues to accept Section 301 List 3 product exclusion requests submitted through its online portal. On August 2, 2019, granted exclusions were announced for 10 specially prepared product descriptions, which cover 15 separate exclusion requests.

The granted exclusions will apply as of the September 24, 2018 effective date of the $200 billion action, and will extend for one year after the publication of the notice.

USTR will continue to evaluate exclusion requests on a rolling basis until the submission deadline, September 30, 2019.
