EXCLUSIONS GRANTED: On September 17, 2019, the USTR announced additional exclusion requests granted to products on Lists 1, 2 and 3. CBP will issue instructions on entry guidance and implementation through its Cargo Systems Messaging Service.
All exclusions are available for any product that meets the description in the Annex to each notice, regardless of whether the importer filed an exclusion request. The scope of each exclusion is governed by the scope of the product descriptions in the Annex, and not by the product descriptions set out in any particular request for exclusion.
The USTR will continue to accept Section 301 List 3 product exclusion requests through its online portal until the submission deadline, September 30, 2019.
Details of the granted exclusions are below.
LIST 1: The exclusions granted to List 1 products are reflected in 310 specially prepared product descriptions, which cover 724 separate exclusion requests, outlined in the Annex to the notice. These exclusions will apply as of the July 6, 2018 effective date of the $34 billion action, and will extend for one year after the publication of the notice. View the notice here.
LIST 2: The exclusions granted to List 2 products are reflected in 89 specially prepared product descriptions, which cover 400 separate exclusion requests, outlined in the Annex to the notice. These exclusions will apply as of the August 23, 2018 effective date of the $16 billion action, and will extend for one year after the publication of the notice. View the notice here.
LIST 3: The exclusions granted to List 3 products are reflected in 38 specially prepared product descriptions, which cover 46 separate exclusion requests, outlined in the Annex to the notice. These exclusions will apply as of the September 24, 2018 effective date of the $200 billion action, and will extend until August 7, 2020. View the notice here.
